These Traveller Terms outline the responsibilities and expectations for all travellers (“you,” “traveller,” “client”) participating in tours organized by Nyumbu Trek Limited (“Nyumbu Trek,” “we,” “us”), a company registered under the Companies Act, 2002 of Tanzania. These terms are incorporated into the Nyumbu Trek Terms and Conditions (T&Cs), which govern the overall booking and contractual relationship. In case of conflict, the T&Cs prevail unless otherwise specified.
By booking a tour with Nyumbu Trek, you agree to comply with these Traveller Terms, ensuring a safe, respectful, and enjoyable experience for yourself, fellow travellers, our staff, and the communities we visit.
1. Preparation and Documentation
1.1 Travel Documents
You are responsible for ensuring you have all necessary travel documents, including:
- A valid passport (with at least 6 months validity beyond your travel dates).
- Required visas for all destinations on your itinerary.
- Vaccination certificates (e.g., yellow fever, as required by Tanzanian or other African authorities).
- Travel insurance documentation (as required under Section 7 of the T&Cs).
Nyumbu Trek will provide guidance on entry requirements, but it is your responsibility to verify and obtain these documents. We are not liable for delays, costs, or tour cancellations due to non-compliance.
1.2 Health and Fitness
Our tours, including safaris and mountain treks (e.g., Kilimanjaro), may involve physical exertion, high altitudes, and remote locations. You must:
- Ensure you are in good health and physically fit for the activities outlined in your itinerary.
- Inform us at booking of any medical conditions, disabilities, or dietary requirements that may affect your participation (as per Section 8 of the T&Cs).
- Consult a medical professional before travel to confirm your fitness, especially for high-altitude treks or tours involving long drives or walking safaris.
Nyumbu Trek is not liable for health issues arising from failure to disclose relevant conditions or inadequate preparation.
1.3 Travel Insurance
As per Section 7 of the T&Cs, you must have comprehensive travel insurance covering:
- Medical expenses (minimum USD 100,000).
- Emergency evacuation (minimum USD 50,000).
- Cancellation/curtailment, baggage loss, and high-risk activities (e.g., trekking, safaris).
You must carry proof of insurance during the tour and provide it upon request. Nyumbu Trek is not responsible for costs or losses due to lack of adequate coverage.
2. Conduct and Safety
2.1 Compliance with Instructions
You must follow all safety instructions provided by Nyumbu Trek guides, drivers, or third-party suppliers (e.g., park rangers, lodge staff). This includes, but is not limited to:
- Wearing seatbelts in vehicles.
- Using safety equipment (e.g., helmets for trekking or harnesses where provided).
- Adhering to wildlife safety protocols (e.g., maintaining a safe distance from animals, staying inside vehicles during safaris unless instructed otherwise).
High-Risk Activities: For mountain treks, travellers must use provided safety gear (e.g., helmets, harnesses) and follow altitude acclimatization protocols as instructed.
Failure to comply may result in immediate removal from the tour without refund, as per Section 5.3.2 of the T&Cs.
2.2 Prohibited Behavior
You must not engage in behavior that:
- Endangers yourself, other travellers, staff, or local communities (e.g., approaching wildlife, ignoring guide instructions).
- Causes distress or annoyance to others (e.g., excessive noise, disruptive behavior).
- Violates local laws, customs, or regulations (e.g., drug use, littering, or unauthorized photography of locals).
Travellers under 18 must be supervised by a parent or guardian at all times. Minors may be restricted from high-risk activities (e.g., walking safaris) at the guide’s discretion.
Nyumbu Trek reserves the right to terminate your tour without refund if your behavior violates these terms, as outlined in Section 14 of the T&Cs.
2.3 Alcohol and Smoking
Alcohol consumption is permitted only in designated areas (e.g., lodges, camps) and must not interfere with tour activities or safety. Smoking is prohibited during activities (e.g., safaris, treks) and in shared vehicles or accommodations, except in designated smoking areas. Violation may result in removal from the tour without refund.
3. Responsible Tourism
3.1 Environmental Responsibility
Nyumbu Trek is committed to sustainable tourism. You must:
- Avoid littering; dispose of waste in designated bins or carry it out if none are available.
- Refrain from picking plants, disturbing wildlife, or removing natural items (e.g., rocks, shells) from parks or reserves.
- Follow park and reserve rules (e.g., staying on designated paths, not feeding animals).
Non-compliance may result in fines by local authorities, which you will be solely responsible for, and may lead to tour termination without refund.
3.2 Cultural Respect
You must respect the cultures, traditions, and communities of the areas we visit:
- Dress appropriately (e.g., modest clothing in rural villages or religious sites).
- Ask permission before photographing or filming local people or their property.
- Avoid actions that may offend local customs (e.g., public displays of affection, disrespectful language).
- Support local communities by purchasing souvenirs from authorized vendors and tipping guides or staff according to local customs (guidance provided by Nyumbu Trek).
Nyumbu Trek will provide guidance on local customs, but it is your responsibility to act respectfully. Violations may lead to removal from the tour without refund.
3.3 Wildlife Protection
Maintain a safe distance from wildlife at all times, as instructed by guides. Do not feed animals or attempt to interact with them, as this can harm ecosystems and endanger safety. Report any injured or distressed wildlife to your guide immediately.
4. Personal Belongings and Safety
4.1 Luggage and Belongings
You are responsible for your personal belongings at all times. Nyumbu Trek is not liable for loss, theft, or damage to items, including luggage, cameras, or valuables. Follow luggage restrictions provided in your itinerary (e.g., weight limits for domestic flights, soft bags for safaris). Keep valuables secure and avoid displaying expensive items (e.g., jewelry) in public areas.
4.2 Personal Safety
Stay with your group and guide during activities, especially in remote areas or national parks. Inform your guide immediately of any safety concerns, health issues, or emergencies. Be aware of your surroundings, especially in urban areas or markets, to avoid theft or scams. Nyumbu Trek will provide safety briefings, but you are responsible for taking reasonable precautions.
5. Health and Hygiene
5.1 Health Precautions
Follow health advisories for the regions you visit (e.g., malaria prevention, hydration at high altitudes). Travellers must take malaria prophylaxis as advised by a doctor, use insect repellent, and sleep under mosquito nets where provided. Bring sufficient personal medications and inform your guide of any medical needs. Report any illness or injury to your guide immediately for assistance.
5.2 Hygiene Standards
Maintain personal hygiene to ensure group comfort, especially in shared accommodations (e.g., camps, lodges). Follow camp or lodge rules for water usage, waste disposal, and sanitation. In remote areas, facilities may be basic (e.g., pit latrines, bucket showers). You must be prepared for these conditions. Nyumbu Trek is not liable for health issues arising from failure to follow these guidelines.
6. Photography and Media
6.1 Personal Use
You may take photos or videos for personal use, subject to local laws and cultural sensitivities (see Section 3.2).
6.2 Commercial Use
Photos or videos taken during Nyumbu Trek tours may not be used for commercial purposes without written consent. You may not sell or distribute media that includes Nyumbu Trek staff, other travellers, or local communities without permission.
6.3 Nyumbu Trek’s Media Rights
By participating in a tour, you grant Nyumbu Trek the right to use photos or videos of you (taken by our staff or shared by you) for promotional purposes, unless you object in writing at booking.
7. Emergencies and Force Majeure
7.1 Emergency Procedures
Follow your guide’s instructions during emergencies (e.g., wildlife encounters, medical incidents, natural disasters). Nyumbu Trek will coordinate with local authorities and emergency services as needed, but you must cooperate fully.
7.2 Force Majeure
As per Section 15.1 of the T&Cs, Nyumbu Trek is not liable for disruptions due to force majeure (e.g., natural disasters, pandemics, political unrest). You must adhere to safety protocols during such events and understand that itinerary changes may occur without compensation.
8. Acknowledgment of Risks
You acknowledge that Nyumbu Trek tours involve inherent risks, including but not limited to:
- Wildlife encounters (e.g., potential for animal attacks).
- Remote locations with limited medical facilities.
- Rough terrain, extreme weather, and physical exertion.
- Endemic diseases (e.g., malaria, dysentery).
By participating, you accept these risks and agree to take reasonable precautions, as outlined in Section 11 of the T&Cs.
9. Compliance with Local Laws
You must comply with all local laws and regulations in the countries visited, including:
- Immigration and customs regulations.
- Wildlife protection laws (e.g., poaching prohibitions).
- Public behavior laws (e.g., alcohol consumption, dress codes).
Nyumbu Trek is not liable for fines, arrests, or deportations resulting from non-compliance, as per Section 14 of the T&Cs.
10. Agreement
By booking a tour with Nyumbu Trek, you confirm that you have read, understood, and agree to these Traveller Terms, in addition to the Nyumbu Trek Terms and Conditions. Disputes arising from these Traveller Terms will be resolved as per Section 18 of the T&Cs. Failure to comply may result in removal from the tour without refund, as outlined in the T&Cs.
